Digital Participant Service Agreement

1. Parties and Scope

1.1. This agreement is made between Elite Diving A.Ş. and LARES SEYAHAT ACENTESİ TURİZM EMLAK İNŞAAT OTOMOTİV TİC. VE SAN. LTD. ŞTİ., which owns the e-organization platform elitedivingcentre.com.tr (hereinafter referred to as Elite Diving), and the participant who purchases the package.

1.2. This agreement is valid from the date the participant makes a reservation and remains in effect until the end of the purchased organization.


2. Package and Participation Conditions

2.1. The “Activity and Diving Packages” offered by Elite Diving are activity-based programs and not standard vacation packages. The participant acknowledges that they have reviewed the details and rules of the activities on elitedivingcentre.com.tr and accepts them.

2.2. The participant fully understands the contents of the selected package and agrees to all details and dates of the organization.

2.3. Flights:
Round-trip flight tickets from the UK to Dalaman are included in the package price.
Flight ticket reservations will be sent to the email address provided by the participant at the time of booking.
A standard economy class ticket is provided. The participant can purchase additional services such as extra baggage or seat selection at their own expense during check-in.
Flight tickets are issued in the name of the registered participant and cannot be transferred to another person.
The participant is responsible for complying with airline check-in deadlines and baggage policies.

2.4. Airport Transfers:
Private transfer from Dalaman Airport to the hotel is included.
Return transfer from the hotel to Dalaman Airport at the end of the holiday is included in the package.
The participant is responsible for providing accurate flight details. Elite Diving is not liable for any issues arising from incorrect information.

2.5. Accommodation:
The package price includes shared accommodation in a double room (per person basis).
Participants who register alone will share a room with another participant of the same gender.
If a participant prefers to stay alone, they must pay the single-room supplement.


3. Participation, Check-in & Check-out, and Program Flow

3.1. The participant is responsible for arriving at the designated airport on the date and time stated on their flight ticket.

3.2. Hotel check-in and check-out dates are determined based on the reservation details.

  • If a participant wishes to check in earlier than the reservation date, they may extend their stay by paying an additional fee, subject to hotel availability.
  • If a participant arrives late or misses any days of their holiday, no refunds will be provided for missed services.

3.3. All activities included in the program are covered by the package price.

  • All activities take place at scheduled times.
  • If a participant voluntarily chooses not to participate in any activity, no refund will be issued.
  • Activity dates may change due to weather conditions or other unavoidable circumstances.

4. Cancellation, Changes, and Refund Policy

4.1. The participant may cancel their reservation under the following conditions:

🔹 4.1.1. Cancellation Before Flight Ticket Purchase

  • If the participant cancels within 48 hours of booking, a 100% full refund will be issued.
  • If the flight ticket has not yet been purchased and the participant cancels, a full refund will be provided.

🔹 4.1.2. Cancellation After Flight Ticket Purchase

  • If a participant cancels after their flight ticket has been purchased, the airline’s cancellation/penalty fee will be deducted from the refund.
  • If the airline does not issue a refund or applies a cancellation fee, this amount will be deducted from the participant’s refund.

🔹 4.1.3. Cancellation 8 Days or More Before the Start Date

  • All fees except the flight ticket will be refunded.
  • If the flight ticket is refundable or changeable, the remaining amount after the refund will be paid to the participant.

🔹 4.1.4. Cancellation Less Than 8 Days Before the Start Date

  • 30% of the total payment will be deducted.
  • If the flight ticket is non-refundable, the ticket cost will not be refunded.

5. Date Changes & Package Transfer

🔹 5.1. Date Change Requests

  • A participant may change their travel date for free if the flight ticket has not been purchased yet.
  • If the flight ticket has already been purchased, the airline’s date change fee will apply.
  • If the new date is more expensive, the participant must pay the price difference.
  • If the new date is cheaper, no refund will be given.

🔹 5.2. Transfer of Package to Another Person

  • A participant may transfer their holiday package to another person.
  • A written request must be made at least 5 days in advance.
  • The new participant must agree to all terms and conditions of this agreement.

6. Force Majeure and Special Conditions

6.1. In cases of war, natural disasters, pandemics, or government decisions that prevent the organization from taking place, the full amount will be refunded.

6.2. Elite Diving reserves the right to make changes to the program if necessary.

  • In such cases, participant approval is not required, and no compensation will be issued.

7. Legal Conditions and Jurisdiction

7.1. This agreement is valid for all bookings made through www.elitedivingcentre.com.tr.

7.2. Elite Diving reserves the right to modify this agreement without prior notice.

7.3. Fethiye Courts and Enforcement Offices have jurisdiction over any disputes arising from this agreement.
